The Fiduciary Advisor in our San Francisco location is responsible for supporting the Chief Fiduciary Officer in providing fiduciary guidance and expertise to Trust & Fiduciary Services staff and oversight of fiduciary administration and custody services activities. The position has both trust administration and regulatory compliance aspects and also acts as a support for both new and existing trust business. Responsibilities include review of trust documents for prospects interested in naming Boston Private as trustee or agent; ensuring compliance with Boston Private Trust & Fiduciary Services policies and procedures and assisting trust administration with technical fiduciary issues and the administration of special assets held in trust.

Responsibilities
  • Support the Chief Fiduciary Officer in the execution of fiduciary activities, including ensuring appropriate Trust Officer and Trust Associate administration of fiduciary relationships
  • Conduct detailed review of trust documents for new trust business to ensure that Boston Private is able to execute its responsibilities as trustee under its policies, procedures, guidelines, and regulatory requirements
  • Act as a support component of the trust sales process by working closely with front office staff to identify prospective obstacles to Boston Private’s ability to act as trustee or agent, and to propose options. Identify relevant issues and communicate same to the Chief Fiduciary Officer, Team Leaders, fiduciary advisors, wealth advisors, trust officers, prospects, investment advisors, third party administrators, and/or prospect’s attorney, and coordinate changes to trust documents or court action as appropriate
  • Review trust instruments in partnership with fiduciary advisors and trust officers and prepare accurate abstract/synopsis of relevant provisions as well as trust digests
  • Support the drafting of appointment documents and review prior trustee removal or resignation documents
  • Work with the Chief Fiduciary Officer, fiduciary officers, trust officers, and fiduciary administrator, et al. to onboard new trust accounts, spot issues, and ensure proper account set up and trust administration from inception
  • Review successor trustee documents upon request
  • Review and approve submitted Reg 9 reviews
  • Provide needed support in the trust termination and splitting process, including review of receipt, release, and refunding agreements
  • Serve as a fiduciary resource for special assets such as real estate and life insurance
  • Assist trust administration, as needed, in coordination with internal and external counsel in the timely and accurate preparation and filing of annual court accountings
  • Provide support and oversight in the review of draft promissory notes, non-judicial settlement agreements, delegation agreements, waivers, declination documents, and other documentation required in the course of responding to new trust opportunities and in ongoing trust administration
  • In support of the Chief Fiduciary Officer, perform ongoing compliance and regulatory research to ensure that Boston Private is compliant with applicable state and federal statutes and regulation relating to the business activities of Trust & Fiduciary Services
  • Participate in and provide guidance and coaching with respect to discretionary and non-discretionary distributions, including the review of requests for content and appropriate supporting documentation, review of powers to adjust or unitrust conversions, special investment requests, etc.
  • Assist with ensuring that Boston Private’s policies and procedures and workflows remain up to date and compliant
  • Assist the Chief Fiduciary Officer in managing risk by monitoring fiduciary activities and ensuring policies and procedures are followed
  • Deliver training to Trust & Fiduciary Services colleagues on trust administration and fiduciary topics
  • Support the Chief Fiduciary Officer in the regulatory examination process, including liaising with Compliance and Risk Management in the coordination and delivery of examination deliverables
  • Perform additional special projects as needed such as assisting with new technology initiatives and workflows, remediating items from internal audits and collateral review
Qualifications
  • Bachelor’s degree from an accredited college or university
  • At least 10 years’ experience working in a trust bank with increasing responsibilities in areas of fiduciary administration and/or fiduciary compliance
  • Working knowledge of trust and fiduciary products and services, income and principal accounting, personal and trust income taxation, estate tax, gift tax, GST tax, investments, trust and estate law, estate planning, retirement plans, and the laws and regulations that govern
  • Experienced with research services and able to provide authoritative fiduciary guidance
  • Demonstrated success in regulatory, compliance, or risk management environment
  • JD, CTFA, CFP, or MBA is highly encouraged
  • Strong organizational skills and attention to detail
  • Excellent customer service and communication skills, both verbal and written
  • Ability to effectively interface with various constituents, including management, trust officers, regulators, outside attorneys, and others in a positive, friendly, and timely manner
  • Strong presentation skills and ability to relay complex information simply
  • Ability to adapt to an ever-evolving environment, multi-task, and prioritize work to maintain efficiency
