The Role Responsibilities


Product and business advisory work
  • Providing compliance coverage and advice to the Financial Markets.
  • Engages with the sales and trading desks to provide Compliance advice to the business.
  • Work closely with the business to provide timely regulatory compliance advice to ensure compliance with all relevant laws and regulations and support the transition to pro-active and premptive compliance and conduct risk mitigation
  • Assists in the identification of material regulatory and reputational risks in the business.
  • Anticipates and assesses key regulatory and product risk trends in the business for management consideration and drive the development and implementation of appropriate risk mitigation measures.
  • Review and provide compliance inputs on processes designed by the Business to ensure compliance with regulatory requirements and the Bank's policies.
  • Provide robust challenge to senior management and all relevant business stakeholders where activities are outside risk tolerance/ appetite, escalating as necessary, until appropriate oversight and ownership is achieved including actions and plans to address any remedial action needed to come back within risk tolerance/ appetite.
  • Undertakes continual assessment of regulatory risks associated with new/ existing products and markets (including those utilizing new trading platforms).
  • Assists in approving new products and new business initiatives.
  • Assists in management and implementation of the product compliance coverage framework and in the preparation and distribution of management information in relation to the product compliance coverage.
  • Ensure proactive and timely identification, assessment, advice and dissemination of evolving regulatory changes/practices and associated risks, and proactive engagement in regulatory reform.
  • Participates in the governance forums of the businesses.
Controls Development and Implementation
  • Develops appropriate Compliance policies and procedures applicable to the business.
  • Establish and maintain effective processes (including training, advice and support) to ensure that policies, procedures and standards to address compliance risks are effectively implemented.
  • Assists in the development and enforcement of product compliance standards and controls.
  • Ensures appropriate documentation of controls and control decisions.
  • Works collaboratively with the business and Risk partners in enhancing the Enterprise Risk Management Framework (ERMF). Assists to establish and maintain appropriate risk based compliance frameworks for identifying, assessing, managing, monitoring, mitigating and reporting compliance (including regulatory and financial crime) risks across the business.
  • Act as Risk Owner under the ERMF, and review at periodic intervals to make an assessment of risks.
  • Provide support and challenge to the Bank's senior management to ensure that they establish and monitor appropriate processes for compliance with compliance policies, procedures and standards (including meeting regulatory obligations and maintaining high standards of conduct).
Country, Regional, Global and Regulatory Support
  • Prepares / reviews reports for Country, Business and Regional compliance management and various risk/ country governance on key compliance risks and issues.
  • Ensures timely escalation of incidents, control breaches to relevant stakeholders, e.g. in Compliance, Business and Country management.
  • Ensures timely and complete responses to regulatory inquiries and surveys.
  • Assists Hong Kong CFCC teams, particularly with regard to regulatory inquiries, investigations, complaint handling, compliance monitoring review, etc.
  • Supports HK CCIB CFCC team in general and regulatory compliance matters, including licensing, outsourcing applications, regulatory filings and notifications.
  • Assist and work closely with Shared Investigative Services (SIS) in relation to investigations concerning the relevant CIB & CB business in the Country.
  • Maintain adequate management MI / trackers and to ensure all issues and matters are tracked, followed, regularly assessed and reported on.
  • To establish relationships, where appropriate, with the local regulators and industry associations.
  • Ensure global standards are understood and implemented in locally, with any identified exceptions, or need for more/less stringent standards escalated to Group Compliance for joint decision-making. Collaborate with the other Products Compliance teams and the Compliance Management Group to anticipate horizon risks that may have a significant impact on the Bank and develop effective strategies to mitigate such horizon risks including global standards for conduct of business.
Training
  • Actively participates in the delivery of a program of initiatives that educates and encourages FM supervisors and staff to operate in compliance with relevant laws, regulations and policies.
  • Provides focused product training and adhoc training as and when appropriate.
  • Assists in the development of an effective internal business compliance culture by promoting the benefits of ethical business conduct and the benefits of compliance.
  • Distributes knowledge on "lessons learned" across various jurisdictions to Country Compliance teams.
Monitoring / Reporting
  • In collaboration with the CFCC Assurance team ensure that local risks associated with the FM business in HK and GCNA are reflected in country risk assessments, with compliance reviews established where necessary and ensure Compliance involvement in the resolving and identified regulatory or compliance issues relevant to the businesses. Escalate to Group Compliance where required.
  • Prepares papers/ reports for the Compliance management team.
Networking and Strategy
  • Support and implement the vision, strategy, direction and leadership for Hong Kong, Regional CCIB and Group FM Compliance, consistent with vision and strategy for Group CFCC function and in support of the Bank's strategic direction and growth aspirations.
  • Build and maintain an effective and constructive relationship with all key business and functional stakeholders that is based on trust, capability and integrity, providing timely, responsive and quality regulatory compliance advice and guidance.
  • Works collaboratively with Group / Regional / Country Compliance to assist in resolving regulatory and reputational issues.
  • Endeavors to keep all relationships on a strong professional footing

Our Ideal Candidate

Technical Knowledge
  • Possesses core technical knowledge of FX, rates, credit and commodities products in Financial Markets and high level understanding of various laws and regulations applicable to the businesses for which he/she is responsible.
  • Has a core grasp of the sales and transactional activities of the business, its operating model, and its key risks.
  • Basic familiarity with sales and trading compliance risks, such as best execution, market manipulation, mis-selling in relation to these products.
Compliance Skills
  • Core knowledge in risk identification, risk assessment, controls development, training, monitoring and reporting.
  • Core experience shown by demonstrable achievements in the above areas.
  • HK regulatory experience in relation to financial markets
Analytical Skills
  • Core ability to analyse relevant laws and regulations and co-relate regulatory issues to products and business models.
  • Core ability to identify and articulate compliance issues.
  • Core problem solving and solution finding skills.
Communications and Client Management Skills
  • Core presentation skills.
  • Core teamwork skills.
  • Core ability to ensure that relevant stakeholders receive relevant and timely information on developments in compliance or in the business.
  • Core ability to use communications channels appropriate to the situation.
  • Introductory ability to lead discussions around complex problems with relevant stakeholders.
  • Introductory ability to drive the compliance agenda with senior business leaders.
  • Introductory investigation / interview skills.
Other Requirements
  • 6 to 10 years overall experience in Compliance supporting Financial Markets
  • Mandarin speaking is preferred.
  • Regulatory knowledge in Hong Kong and/or China
